The Dirty Little Secret With Virginia’s Dwi Testing Program

The Department of Forensic Science (DFS) has always told Virginia’s judges, prosecutors, police officers and defense attorneys that its Intoxilyzer 5000 (68) machines are well maintained, accurate and reliable. DFS placed them into service over three years 1995-1997.

DFS has now decided to replace these ten to twelve year old machines. Why? Just look what DFS says privately.

“These instruments are dated and the manufacturer is no longer maintaining parts or able to fully support them since the current instruments demonstrate two further generations of technology advancement.”

“To replace dated, unstable and unreliable Breath Alcohol instrumentation used by police officers throughout the Commonwealth to certify whether a driver is or is not impaired.”

“Funding of this request will allow the agency to replace instruments that are 9-10 years old and for which replacement parts are not available.”

“Over the past several years, new technology in the field of breath testing has come to the forefront. At the same time, the Intoxilyzer 5000 is being phased out of production by the manufacturer as some of its electronics components become more difficult to replace.”

“We need to obtain and implement new equipment because some Intoxilyzer units are already 10 (almost 11) years old. The manufacturer is not longer making all the same parts. The motors the instrument currently uses no longer lasts very long (due to changes in the manufacturing). To use any new replacement parts that are not identical to the original have to undergo evaluations, testing for approval before we can put them in the field.”

“I-5000 Dislikes…Limited ability to troubleshoot from Richmond…Accepts lot #’s of solutions that are expired or have incorrect # of digits…Not able to tell when solution was changed unless recorded in logbook…”

“These instruments are outdated and the manufacturer is no longer maintaining parts and not capable of fully supporting them since current instruments demonstrate two further generations of technological advancement.”

“The CMI representative was in yesterday and these are some of the problems that were raised. The IR source that is currently being sold is having problems with sensitivity and transitioning between motors…The motors are another issue, the current motor will be discontinued as of January 1, 2006. The “replacement motors” are in short supply…CMI doesn’t want to continue to support the 5000 line since they have 2 generations of instruments produced since that time.”

Your training contract application form is your primary personal marketing tool and is often the first contact you will have with decision makers at the firm.

Deadlines are meant to be met.

You have to be in it to win it, and it only makes sense to give yourself as many opportunities as possible. Do yourself a favor by getting all the dates for submission for each of the firms that you are going to be making a submission before doing anything else. Form an easier life by organizing all the details into a format that is simple to admit and understand. A time line is very helpful to estimate and organize each submission deadline so that you know how much time to complete each on them on time.

Don’t make spelling and grammar an issue

With a large amount of submission that are being scrutinized by firms these days, online submission has become the method of choice for many. While the convenience of online submission systems has a lot of clear benefits, it has also been the cause and source of mistakes for applicants. One of these is mistakes in basic spelling and grammar, more likely to be caused by carelessness than anything else. Even if you are typing directly into the recruiter’s website, it is not much trouble to copy and paste into Word for some assurance that you haven’t made any basic errors that will detract from the worth of your application. Simple and easy to do, and well worth the extra effort.

Give yourself sufficient time to prepare

Failing to prepare is preparing to fail. As the saying indicates, you should really be prepared for all possibilities, especially when it comes to something as important as your training contract submission. There are enough stories about submission systems breaking down, or being overloaded with traffic in the dying minutes to make any applicants nervous. From the perspective of the firm, an early and well-prepared submission still has an advantage than a last-minute but well-prepared submission. Make sure that the quality of your submission matches your ability by having plenty of time up your sleeve.

Proofreading can make all the difference

Proofread as many times as possible to help eliminate unnecessary mistakes on your application. Proofreading is not just about going over the document once over, but to progressively reduce errors and improvement sentence flow by reviewing the work at different stages of its production. Do this, and you will find a vast improvement, as well as a greater polish on your work. If possible, find someone who is willing to help you go through the application. By putting yourself in the shoes of others can be very useful in determining those errors you missed, or gathering some ideas that are unclear to others.

Make your application easy on the eyes

What better way to demonstrate to the recruiters that you have all the skills and ability for the job by making your application stand out. With so many applications that they must go through in a short amount of time, being able to communicate ideas in a clear and concise manner will make any reviewer of your application sit up and take notice. Don’t introduce informal language into your application, because the online submission process is still treated as a formal piece of document. Give your potential employers some idea about your personality with the way you write and communicate your ideas. Avoid long sentences that may obscure the ideas you are trying to set forth.

Judge Rejects ‘Obscene’ Name Change

SANTA FE, N.M. (June 28) - A New Mexico appeals court on Friday ruled
against a Los Alamos man who wanted to change his name to a phrase
containing a popular four-letter obscenity.

The man appealed after a state district judge in Bernalillo
County refused his request to change his name to “F—
Censorship!”

Judge Nan Nash ruled that the proposed name change was
“obscene, offensive and would not comport with common decency.”

The Heller Vs Dc Decision-supreme Court-the Reality

I, for one, was really happy about the Supreme Court’s decision regarding “Heller vs DC”. For once—the Anti-Gun crowd has taken a hit, in their claim that the 2nd Amendment wording “Right of The People”, does not in fact mean “The People–Citizens–Just Me and You”. The Supreme Court has determined otherwise. Not only was this a “Blackeye” for the Anti-Gun crowd, but also a reason of celebration for the Pro-Gun crowd, and indeed, alot of us did celebrate! However–Let’s look at this “Victory” very carfully!

The Justices determined that the wording, did indeed refer to the people, giving the people the “Right to keep and bear arms”. A more in depth reading of the decision, clarifies the true judgement of the Justices.

 

1. “…violate the Second Amendment Right of individuals…”
THE COURT RULED TODAY THAT THE SECOND AMENDMENT IS AN INDIVIDUAL RIGHT, AND THE BAN VIOLATED IT.

2. “…who are not affiliated with any state-regulated militia…”
THE COURT RULED TODAY THAT MILITIA STATUS IS IMMATERIAL.

3. “…handguns and other firearms…”
THE COURT RULED TODAY THAT HANDGUNS ARE INCLUDED, THOUGH SOME ROOM WAS LEFT FOR VERY NARROW TYPES OF GUN BANS

4. “…for private use in their homes.”
THE RULING TODAY WAS LIMITED TO “IN THE HOME” AS THAT WAS ALL THAT WAS IN FRONT OF THE COURT

This is definitly a victory in our quest for the True wording of the Second Amendment—But the True Battle has just started. San Francisco and Chicago are the first targets of the NRA and Pro-Gun groups. The decision of the Supreme Court will be the focal point of these lawsuits, and you can be certain, that the lawyers for these cities will have one thing on their mind—The Supreme Court ruling Did Not eliminate the power of the States to pass “Reasonable” laws to protect their citizens. What is “Reasonable”? That makes a good question for a Second “Supreme Court Decision”.

The fact is–There will be numerous “Reasonable” laws passed, ( Or shall we say Reasonable Infringements ), by numerous Cities and States, using the LOOPHOLE, that the Supreme Court Ruling has provided ( See Numbers–3 and 4 ). This is the upcoming battle, Not a challenge of the Justices decision—-a Challenge of what the Justices Did Not Decide.
